Data protection policy for the applicant management system

Engel & Völkers GmbH (hereinafter referred to as “Engel & Völkers”), with its offices in Vancouverstr. 2 a, 20457 Hamburg, Germany, in its quality either of a data controller (hereinafter referred to as “Data Controller”) or as a data processor (hereinafter referred to as “Data Controller”) of companies of the Engel & Völkers Group, informs you that it processes identifying personal data (e.g. name, surname, e-mail address, phone number, your current cv, your user account – hereinafter “personal data” or “data”).

The Engel & Völkers Group includes Engel & Völkers GmbH as well as their respective subsidiaries and second-tier subsidiaries, and their national and international (master) licensing partners. By sending your application to Engel & Völkers and/or submitting it online and/or creating an account on the Engel & Völkers’ website you provide your personal data to the Engel & Völkers Group within the applicant management system.

In addition Engel & Völkers possess personal data transmitted by you via the internet browser every time our website is accessed. It is referred to the privacy policy you can find on the website.

Purposes of the processing

Engel & Völkers processes your personal data without your prior consent for the following purposes:

  • To give you an opportunity to apply for vacancies offered by the Engel & Völkers (in this case, the legal basis for the personal data processing is the contract fulfilment, as well as the legitimate interest of Engel & Völkers in passing on applications to the competent unit or company within the Engel & Völkers Group);
  • To manage your application at Engel & Völkers (legal basis is the contract fulfilment and legitimate interest of Engel & Völkers in ensuring a well-functioning applicant data management);
  • To enable you to create an applicant account and a digital applicant data file in the course of a registration procedure (legal basis is the contract fulfilment);
  • To fulfil the respective requests (legal basis is the contract fulfilment);
  • To collect data for statistic surveys (legal basis is the legitimate interest of Engel & Völkers in ensuring a functional applicant data management system);
  • To prevent fraudulent activities or abuse on the website or in connection with the website and to comply with the legal requirements on the website safety (legal basis is the legitimate interest of Engel & Völkers in elimination of disturbances and errors, in ensuring the system security and in detecting an illegal access or attempts of illegal access.). 
  • The legal basis for the personal data processing is Article 6 para I sub-para. a, provided that the processing is based on a data subject’s consent, Article 6 para. I sub-para b. of the GDPR, provided that the data processing is necessary due to a contractual relationship, and Article 6 para. I sub-para. f. of the GDPR, if the data processing is done due to a legitimate interest of Engel & Völkers.
Furthermore, Engel & Völkers processes your personal data with your prior consent in order to inform you about other interesting vacancies, at the discretion of Engel & Völkers or its companies to which your application was originally addressed.

Nature of providing personal information and the consequences of the refusal providing personal data is mandatory for the purposes above. You can freely decide not to provide your personal data, but this may prevent you from the application to a job posting or the creation of an account.
Providing personal data in order to be informed about further job openings is voluntary. You can freely decide not to provide your personal data for this purpose, in this case you will not be informed of possible interesting job openings by Engel & Völkers. Anyway, you can apply to a job posting or create an account.

Processing modalities

The processing of your personal data is made only if necessary and it is carried out via electronic or paper means, especially with the operations and namely: collection, registration, organization, storage, consulting, processing, modification, selection, extraction, comparison, use, interconnection, access and communication, blocking, erasure and destruction of the data.

Engel & Völkers processes your personal data only for the time necessary to achieve the above mentioned purposes. However, if you become an employee of Engel & Völkers / an Engel & Völkers Group company the Data Controller does not delete your personal data you provided. In that case your user account will be deleted at that time.

Unused user accounts remain active until they are deleted by the applicant, or are deleted upon their request by the person responsible from Engel & Völkers up to 24 months after the last login.

At the end of the application process, or when you withdraw your application, your data will be deleted in accordance with respective applicable legal regulations, unless you have agreed to the storage of personal data for other job openings. The documents, answers, and, information uploaded during the course of the online application will be stored under your name after the application process is completed. After this, the results are saved by the Data Controller in an anonymous form, without your name for further statistical evaluation.

This statistical data set does not allow any conclusions to be drawn about the person and serves as a basis for statistical evaluations. It is not possible to reactivate an application that has already been anonymised. Anonymisation cannot be reversed.

Engel & Völkers reserves the right to block or delete inactive user accounts at any time.

Secure handling of personal information

When you transfer your data to our applicant management system, the transfer of data is automatically encrypted. Engel & Völkers will treat your data confidentially in accordance with the applicable data protection laws

Applications sent to the Engel & Völkers Group by means other than the central applicant management system (for example via a contact form, email, or letter) are also recorded in the central applicant management system and handled as an application submitted directly via the system.

Access to data

Personal data will be processed by the Data Controller’s staff deputed to the processing of personal data (including, but not limited to):

  • employees and consultants responsible for your application, such as the human resources department or area manager of the Data Controller or a company belonging to the Data Controller’s Group, in their quality of persons in charge of the processing and/or internal data processors;

  • individual, highly-trained administrators and IT support staff who are part of the Data Controller or of the Engel & Völkers Group, who are authorized to manage the website and supply the related services (e.g. customer services, IT department, etc.) in their quality of persons in charge of the processing and/or internal data processors and/or system administrators;

  • third party companies (e.g. IT services providers, hosting providers, etc.) to which the Engel & Völkers outsources some services involving processing operations in their quality of external data processors. Your personal data are not communicated to any third party outside the Engel & Völkers’ Group.;

  • In the event that an applicant applies to a number of different places simultaneously, for example with different license partners of Engel & Völkers Gruppe), we pass on these data to these licence partners upon your prior consent or based on our legitimate interest - however, only to those personnel departments and departments or area managers who officially have access to the application procedure and whom the licence partners have appointed to be in charge for such procedures. If you submitted an application to several vacancies, we will accordingly inform these persons about your application.
Communication of data

The Data Controller may communicate your personal data to third parties in their quality of autonomous data controllers for the following reasons:
  • to permit to third companies a merger, acquisition or sale of all or part of the Data Controller assets;
  • to fulfil the obligation provided by the law, regulations, protocols and national and EU legislation;
  • to implement laws required by public authorities;
  • to allow the defence in court.
Your personal data will not be disseminated.

Data transfer outside the EU

Basically, Engel & Völkers does not transfer personal data to non-EEA countries without your prior consent. The servers used by Engel & Völkers are situated in the European Union. If your inquiry is referred a company of the Engel & Völkers group outside of the European Union, we will transfer your data upon your consent.

Data subjects’ rights

You have the right to obtain from the Data Controller the information about the existence of personal data referring to you and the communication in an intelligible form; the origin of personal data; the purposes and modalities of the processing; an update, correction or integration of data. Moreover, you may, under certain conditions, restrict or revoke your consent to the processing of personal data in the future; request the interruption of the processing; the deletion, anonymization or the block of the information being processed. You may refuse, fully or partially, the processing: a) for legitimate reasons on the processing data concerning them; b) for the purpose of sending advertising material or for carrying out market researches or commercial communications.

You have also the

  • right of confirmation,

  • right of rectification

  • right to be forgotten,

  • right of processing limitation,

  • right of data portability,

  • right to object; and

  • the right to complain to the Supervisor Authority.

  • Please note that your right to delete your data is subject to some restrictions. For example, we need not and/or not allowed to delete data that we are obliged to keep because of litigation hold required by the law. Moreover, the data we need for enforcement, exercise or defence of our legal claims are also excluded from your right of data deletion.

    You can exercise the aforementioned rights by withdrawing your application in your password-protected account and deleting your account, or by notifying it to the Data Controller at the following phone number +49 (0)40 – 36131-200 or e-mail address hotline@engelvoelkers.com.
    In the same way, you can unlock your account if you have previously blocked after five incorrect password entries in order to prevent unauthorised access to applicant data. If you do not unlock the user account, your data will be deleted in accordance with applicable legal regulations.
